Requirements/guidelines for matting, framing and hanging hardware: In order to have a clean and cohesive exhibition design, we ask that if your artwork requires framing, it be framed with a natural, white, or black finish with a flat face and squared-off profile. If a mat is used, a white or off-white mat should be utilized. Please use plexiglass if the work is large. Please use d-ring hangers – same measurement on each side from the top of the frame (about ¼ of the way down) with or without picture wire for your hanging hardware. Please do not use screw eyes. Artist Agreement

1. DURATION: All items shall be in the possession of Tohono Chul Park, Inc. from the date of delivery until the closing date. No items may be removed prior to the close of the exhibit without the permission of the Curator.

2. PRICE: The retail price of the consigned work indicated herein is fixed by the Consignor and Tohono Chul Park, Inc. may sell any one or more of the same for cash or on such terms as it, in its sole discretion, feels is in the best interest of both parties.

3. GALLERY SALES COMMISSION: Tohono Chul Park, Inc. will retain 50% of the indicated price as its sales commission on gallery sales. The balance of the sales price will be mailed to the Artist-Consignor within 30 days of the close of the exhibit.

4. INSURANCE: Tohono Chul Park, Inc. shall use due care to protect the items from all risks while in its possession. Tohono Chul Park, Inc. will insure such items, in accordance with its insurance policy, against vandalism, fire and breakage, and theft or burglary in an amount not less than the net retail price, after commissions.

5. COPYRIGHT: Artist-Consignor warrants that all work submitted shall be work to which the Artist possesses common law copyright.

6. ADVERTISING, PROMOTION AND CREDIT: Artist-Consignor agrees that his/her name and photographs, duplications or descriptions of work may be used in advertising and promotion and for educational purposes by Tohono Chul Park, Inc.

7. REFERRAL SALES: During the course of the exhibit and for 60 days following the closing date, when Tohono Chul Park, Inc. refers one of its customers directly to any Artist-Consignor and such referral results in the sale of art not being shown in Tohono Chul Park, Inc.’s Exhibit Hall, undersigned Artist-Consignor agrees to pay Tohono Chul Park, Inc. 10% of the sales price as Tohono Chul Park, Inc.’s commission for bringing the buyer and artist together. Also, during the course of the exhibit and for 60 days following the closing date, if a customer buys the original or orders a duplicate of an item exhibited at Tohono Chul Park, Inc., the Artist-Consignor agrees to pay Tohono Chul Park, Inc. 50% of the sales price. Upon request, Tohono Chul Park, Inc. shall be entitled to receive from the artist a copy of the invoice disclosing sales price and other pertinent data relating to sales price.

8. SHIPPING POLICY: Artist-Consignor is responsible for the crating and shipping costs of his/her work to the location of Tohono Chul Park, Inc. and return shipping costs, when work is returned. The Artist-Consignor shall assume the risk of loss during crating and shipping of items to and from Tohono Chul Park, Inc.

9. NOTICES: Notices required by this agreement shall be mailed to the parties at the address given on page one, and shall be deemed given when so mailed. It is the artist’s responsibility to notify Tohono Chul Park, Inc. of any change of address, phone number and email address.

10. DISPOSAL: In the event the Artist-Consignor fails to remove consigned items from Tohono Chul Park, Inc. within thirty (30) days after being sent written notice to do so, Tohono Chul Park, Inc. may dispose of said items as it, in its sole discretion, deems appropriate.
